China's Crops Patent Right Realizes Global Transfer for the First Time

Every time a DVD is produced in China, it must pay US$3 to foreign technology owners. Nowadays, every “golden peach” kiwifruit planted in Italy must pay to the Wuhan Institute of Botany, Chinese Academy of Sciences.
According to the "Hubei Daily" report, the cost paid by the Italians is the royalty of patented technology. Huang Hongwen, Ph.D., director of the Wuhan Institute of Botany, told reporters on the 10th: “In the contract signed between us and the Italian Golden Kiwifruit Company on the 5th, the other party increased the royalty payment and thus was authorized to expand the scope of the 'golden peach' to the world. "This is a crop variety of China's independent intellectual property rights and it is the first time that global patent transfer has been achieved.
"Kingtao" kiwifruit was made from 20 years of hard work by Wuhan Institute of Botany, and it has undergone resource investigation, wild selection, real-life acclimatization, and expansion and grafting. Its fleshy fruit is crispy, juicy, and high-yielding, and is better than the famous New Zealand variety “Garden-16A”.
In 2001, Wuhan Plant Institute filed a patent application with the European Patent Office. In that year, the Italian Golden Kiwi Company purchased the "golden peach" breeding rights in the EU market for 10 years with a transfer fee of 172,000 euros. In 2003, the two parties signed a contract again. The company extended the breeding rights of the “golden peach” to the EU in 2028 and agreed to extend it to Chile and Uruguay.
It is estimated that the first payment for the use of patents and the usage fee per hectare in the three contracts will cumulatively exceed 18 million euros by 2028. At present, the Italian side has paid 9.1332 million euros to the Wuhan Plant.
Plant species are strategic resources, and developed countries have always attached great importance to the protection and development of their intellectual property rights. A few years ago, a wild soybean variety in China was applied for patent by the Monsanto Company in 101 countries and regions. To grow this species in the above countries and regions, you must pay money to Monsanto. The success of “Golden Peach” shows the awakening of China’s intellectual property and its strong potential for foreign transfer.
Unfortunately, the right to use patents for the "golden peaches" in the Chinese market was taken away by Italian companies with a down payment of 150,000 euros because there were no domestic companies. Obviously, domestic use rights have been reduced, which has increased the “threshold” for the reproduction of “golden peaches” by domestic enterprises and farmers.
